T\u00fcrk hukukunda \u201cpara \u2014 ancak belgelerden sonra\u201d ilkesi bir tavsiye de\u011fil, yat\u0131r\u0131m\u0131n korunmas\u0131n\u0131n tek yoludur. T\u00fcrkiye\u2019de gayrimenkul haklar\u0131n\u0131n tescil sistemi tamamen sicil esas\u0131na dayan\u0131r: hukuken ge\u00e7erli olan yaln\u0131zca resmi devlet sicillerinde kay\u0131tl\u0131 olan bilgilerdir; s\u00f6zl\u00fc olarak vaat edilen veya pazarlama materyallerinde yer alan beyanlar hukuki de\u011fer ta\u015f\u0131maz.<\/p>\n<p>T\u00fcrkiye\u2019de herhangi bir gayrimenkul\u00fcn \u00fc\u00e7 temel belgeye sahip olmas\u0131 gerekir: <strong>TAPU<\/strong> (m\u00fclkiyet belgesi), <strong>\u0130mar<\/strong> (yap\u0131 ruhsat\u0131\/in\u015faat izni) ve <strong>\u0130skan<\/strong> (yap\u0131 kullanma izin belgesi). Ayr\u0131ca tapu sicilinde kay\u0131tl\u0131 <strong>\u0130potek<\/strong> \u2014 rehin, ipotek ve takyidatlar\u0131n bulunmad\u0131\u011f\u0131 da kontrol edilmelidir. Bu belgelerden herhangi birinin bulunmamas\u0131 veya belgelerdeki herhangi bir uyumsuzluk, i\u015flemden vazge\u00e7ilmesi veya i\u015flemin yeniden de\u011ferlendirilmesi i\u00e7in gerek\u00e7e te\u015fkil eder.<\/p>\n<h2>Blok 1. TAPU \u2014 m\u00fclkiyet belgesi<\/h2>\n<h3>TAPU nedir<\/h3>\n<p><strong>TAPU<\/strong> (Tapu Senedi), T\u00fcrkiye\u2019de bir ta\u015f\u0131nmaz veya arsa \u00fczerindeki m\u00fclkiyet hakk\u0131n\u0131 teyit eden resmi belgedir. Belge, Tapu ve Kadastro Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc (Tapu ve Kadastro Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc, TKGM) taraf\u0131ndan d\u00fczenlenir ve sicile tescil edilir. Belirli bir daire \u00fczerindeki hakk\u0131 teyit etmez; yaln\u0131zca ortak m\u00fclkiyet i\u00e7indeki pay\u0131 g\u00f6sterir. Bu t\u00fcr bir belge, ta\u015f\u0131nmaz\u0131n sat\u0131\u015f\u0131 veya y\u00f6netimi ile ilgili kararlar\u0131n al\u0131nmas\u0131nda malikin haklar\u0131n\u0131 s\u0131n\u0131rlar ve mavi TAPU\u2019lu ta\u015f\u0131nmaz i\u00e7in ipotekli kredi kullan\u0131m\u0131 m\u00fcmk\u00fcn de\u011fildir.<\/p>\n<p><strong>K\u0131rm\u0131z\u0131 TAPU<\/strong>, belirli bir ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm \u00fczerindeki bireysel m\u00fclkiyet hakk\u0131n\u0131 teyit eder. Belgede pay de\u011fil, belirli bir ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm yer al\u0131r (\u00f6rne\u011fin \u201cA Blok, Daire No: 3\u201d). Daire veya ev sat\u0131n al\u0131m\u0131nda hedeflenen belge k\u0131rm\u0131z\u0131 TAPU\u2019dur.<\/p>\n<p><strong>Kat \u0130rtifak\u0131<\/strong> stat\u00fcs\u00fc, binan\u0131n yap\u0131m a\u015famas\u0131nda oldu\u011funu veya yap\u0131 kullanma izin belgesinin (\u0130skan) al\u0131nmad\u0131\u011f\u0131n\u0131 g\u00f6sterir. \u0130n\u015faat halindeki bir ta\u015f\u0131nmaz\u0131n sat\u0131n al\u0131nmas\u0131nda bu durum kabul edilebilir; ancak in\u015faat tamamland\u0131ktan sonra stat\u00fcn\u00fcn Kat M\u00fclkiyeti\u2019ne \u00e7evrilmesi gerekir. Kat M\u00fclkiyeti, \u0130skan\u2019\u0131n mevcut oldu\u011funu teyit eden tam m\u00fclkiyet stat\u00fcs\u00fcd\u00fcr.<\/p>\n<h3>Kim kontrol eder ve ne zaman<\/h3>\n<p>TAPU incelemesi, \u00f6n s\u00f6zle\u015fme imzalanmadan ve kapora yat\u0131r\u0131lmadan \u00f6nce lisansl\u0131 bir avukat veya yetkili bir emlak dan\u0131\u015fmanl\u0131\u011f\u0131 taraf\u0131ndan yap\u0131l\u0131r. Ba\u011f\u0131ms\u0131z kontrol ise <a href=\"https:\/\/parselsorgu.tkgm.gov.tr\" target=\"_blank\" rel=\"nofollow noopener\">parselsorgu.tkgm.gov.tr<\/a> portal\u0131 \u00fczerinden ger\u00e7ekle\u015ftirilebilir; parsel numaras\u0131 ile ta\u015f\u0131nmaza ili\u015fkin temel bilgilere eri\u015filebilir.<\/p>\n<blockquote><p>Temel kural: E\u011fer emlak ofisi veya sat\u0131c\u0131, g\u00f6r\u00fc\u015fmelerin erken a\u015famas\u0131nda TAPU konusunu konu\u015fmaktan ka\u00e7\u0131n\u0131yorsa, bu do\u011frudan bir risk g\u00f6stergesidir.<\/p><\/blockquote>\n<h2>Blok 2. \u0130skan \u2014 yap\u0131 kullanma izin belgesi<\/h2>\n<h3>\u0130skan nedir<\/h3>\n<p><strong>\u0130skan<\/strong> (tam ad\u0131: Yap\u0131 Kullanma \u0130zin Belgesi), ta\u015f\u0131nmaz\u0131n teknik pasaportu niteli\u011finde olup; binan\u0131n proje dok\u00fcmanlar\u0131na uygun \u015fekilde in\u015fa edildi\u011fini, yap\u0131 mevzuat\u0131na, yang\u0131n g\u00fcvenli\u011fi \u015fartlar\u0131na, deprem dayan\u0131m\u0131 ve enerji verimlili\u011fi standartlar\u0131na uydu\u011funu ve altyap\u0131\/\u015febeke ba\u011flant\u0131lar\u0131na haz\u0131r oldu\u011funu resmi olarak teyit eder. Belge, ta\u015f\u0131nmaz\u0131n bulundu\u011fu yerdeki belediye (Belediye) taraf\u0131ndan d\u00fczenlenir.<\/p>\n<p>3194 say\u0131l\u0131 Kanun (\u0130mar Kanunu) uyar\u0131nca, m\u00fcteahhit\/y\u00fcklenici, yap\u0131 ruhsat\u0131n\u0131n d\u00fczenlenmesinden itibaren 5 y\u0131l i\u00e7inde \u0130skan almakla y\u00fck\u00fcml\u00fcd\u00fcr. Genel \u0130skan\u2019\u0131 olmayan bir bina, hukuken oturuma elveri\u015fli kabul edilmez.<\/p>\n<p><strong>Ferdi \u0130skan<\/strong> (Bireysel) \u2014 2020 y\u0131l\u0131 \u00f6ncesinde her daire i\u00e7in ayr\u0131 ayr\u0131 d\u00fczenlenmekteydi. Adres, oda say\u0131s\u0131, metrekare ve malik bilgilerini i\u00e7erir.<\/p>\n<p><strong>Toplu \u0130skan<\/strong> (Toplu) \u2014 2020 sonras\u0131 in\u015fa edilen projeler i\u00e7in getirilen yeni formatt\u0131r. T\u00fcm site\/kompleks i\u00e7in d\u00fczenlenir ve t\u00fcm dairelerin teknik \u00f6zelliklerini kapsar. Sat\u0131c\u0131 takyidat\u0131 gizleyebilir; ancak sicil tam ve g\u00fcncel bilgiyi i\u00e7erir.<\/p>\n<h3>Bor\u00e7suzlu\u011fun nas\u0131l tespit edildi\u011fi<\/h3>\n<p>Takyidat kontrol\u00fc birka\u00e7 a\u015famada ger\u00e7ekle\u015ftirilir:<\/p>\n<p><strong>Ad\u0131m 1<\/strong>. TKGM sicil kayd\u0131 talebi. Tam sicil kayd\u0131 (tapu kayd\u0131), ta\u015f\u0131nmaz \u00fczerindeki t\u00fcm tescilli haklar\u0131, k\u0131s\u0131tlamalar\u0131 ve takyidatlar\u0131 i\u00e7erir. Bu kay\u0131t, malik taraf\u0131ndan veya malikin yetkilendirdi\u011fi ki\u015fi taraf\u0131ndan (noter tasdikli vek\u00e2letname ile) talep edilebilir.<\/p>\n<p><strong>Ad\u0131m 2<\/strong>. parselsorgu.tkgm.gov.tr portal\u0131 \u00fczerinden kontrol. Ta\u015f\u0131nmaz\u0131n temel bilgilerine parsel numaras\u0131 (parsel numaras\u0131) ile online olarak eri\u015filebilir.<\/p>\n<p><strong>Ad\u0131m 3<\/strong>. Vergi borcu kontrol\u00fc. Emlak vergisi borcu (emlak vergisi) belediyeden veya e-Devlet (turkiye.gov.tr) \u00fczerinden kontrol edilir. \u00d6denmemi\u015f vergi borcu yeni malike ge\u00e7er.<\/p>\n<p><strong>Ad\u0131m 4<\/strong>.
